Notice of Financial Incentive and Additional Loyalty Program Disclosure

Portillo’s Perks is a loyalty program that allows participants to receive rewards based on qualifying visits and transactions.  The app-less program is driven by a participant’s use of a digital wallet that allows guests to receive offers and recognition badges based on individual habits.  A digital card tracks visits and uses transaction information to send specialized communications based on badges earned.

Material Terms of Program

              We collect and retain personal information to support and fulfill Portillo’s Perks, which may include the following categories:

• Identifiers (for example, name, phone number, email address, date of birth and/or age)
• Personal records with information that relates to, describes or is capable of being associated with a particular individual, including financial information related to payment or digital wallet 
• Commercial information (for example, purchases, transaction history or tendencies)
• Internet/Network Activity (for example, browsing history or search history on Portillo’s website or app
• Geolocation data (for example, physical location or movements)
• Inferences from personal information collected (for example, guest profiles and purchasing preferences)

How to Opt In to the Program

Participation in the Portillo’s Perks is voluntary and requires your prior opt-in consent. You may enroll in Portillo’s Perks by registering for a Portillo’s account and adding Portillo’s Perks Card to the digital wallet on your mobile device. You can register for a Portillo’s account by:

• Scanning the designated QR code available at our restaurants and on marketing materials
• Registering on our website at portillos.com/signup

Right to Withdraw from the Program and Instructions on How to Withdraw

Participants have the right to withdraw from Portillo’s Perks at any time by deleting or deactivating your account. 

Please note that if you submit a request to delete your personal information, this will also automatically withdraw you from Portillo’s Perks and will result in the forfeiture of your rewards and incentives, including any badges that you may have accumulated. Requesting the deletion of your personal information results in the removal from Portillo’s Perks because we require personal data to associate an individual with the program. 

Explanation of How the Incentive Relates to the Value of the Consumer’s Data

The value of personal information collected through Portillo’s Perks varies based on the individual, the reward or offer and is calculated based on expenses related to the program, which may include costs associated with providing rewards, discounts, promotions, marketing and other related expenses.  Our reasonable determination of the estimated value of personal information collected through our offers and rewards programs takes into consideration, without limitation, estimates regarding the anticipated revenue generated from such information, the anticipated expenses which might be incurred in the collection, storage, and use of such information in the operation of our business, and other relevant factors related to the estimated value of such information to our business, as permitted under the California Consumer Privacy Act.
